Air Alert – EPA defers “Tailoring Rule” requirements for CO2 emissions from bioenergy and other biogenic sources

EPA recently issued a final rule to defer for 3 years the application of Prevention of Significant Deterioration (PSD) and Title V Tailoring Rule permitting requirements to biogenic carbon dioxide (CO2) emissions from bioenergy and other biogenic stationary sources.

This means landfill owners will not have to account for CO2 from flares and engines at landfill sites until the year 2014. To read EPA’s fact sheet on this change to the Tailoring rule, visit EPA.gov.

New tailoring rule expected to bring many more landfills into major NSR PSD permitting

The U.S. Environmental Protection Agency (EPA) recently finalized the Prevention of Significant Deterioration (PSD) and Title V Greenhouse Gas Tailoring Rule, which requires certain stationary emission sources to comply with the Title V and New Source Review PSD provisions of the Clean Air Act (CAA), based on their GHG emissions.

MSW Landfill Mandatory GHG Reporting Rule updates

EPA has recently issued mandatory greenhouse gas (GHG) emissions reporting rules. Under the new rules, which became effective in January 2010, owners or operators of many municipal solid waste (MSW) landfills must report emissions from MSW landfills.

EPA has answered several longstanding questions in its new FAQ document, Mandatory Reporting of Greenhouse Gases Rule New Frequently Asked Questions: Subpart HH, Landfills. In addition, USEPA has provided a template document for a best available monitoring methods extension request.
